"Appeal rejected" were the words uttered from the Judge, as he handed down a London EAT Judgment in the Manchester Civil Justice Centre, that happened to also coincide with yet another junior doctors strike.

We lost because HEE successfully convinced the Judge that it has no substantial influence over its 54,000 doctors careers or long term employment.

HEE or the Deanery's powerful employment functions such as the ARCP and the ability to delete a doctor's National Training number were seen as peripheral or tangential issues by the Judge.

The fact a Deanery formal investigation and the deletion of a doctor's national training number will not be scrutinised in court was not seen as amounting to a "lacuna" in the judgment.

We have yet to be given leave to appeal.
